Terms and Conditions of Sale

 

These Terms and Conditions of Sale, together with any documents that are expressly incorporated by reference, (collectively, “Terms”) apply to all orders for products and services (“Products”) placed with WOK HEY Pte Ltd (“WOK HEY,” “we,” “us,” or “our”), whether through our online ordering platform for self-pickup (e.g., https://pick-up.wokhey.sg/ and its outlet-specific subdomains, “Online Ordering Platform”), in-outlet self-service kiosks (“Kiosks”), or directly with our staff at the outlet cashier (“Cashier”).

Please read these Terms carefully before you place an order and/or make a purchase. By placing an order and/or making a purchase, you, the customer (“you” or “your”), are deemed to have read, understood and agreed to be bound by these Terms and our Privacy Policy (as annexed hereto and available at https://www.wokhey.sg/privacy-policy/) incorporated herein by reference. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WOK HEY concerning your purchase.

WOK HEY offers online ordering for customer convenience, allowing you to place orders for self-pickup at designated WOK HEY outlets. This is not an e-commerce delivery service and WOK HEY does not offer delivery services of any kind. All orders must be collected in person by the customer in person at the selected outlet.

1. Acceptance and Confirmation of Order

a. Placing an Order: You may place an order through the following channels:

i. Online Ordering Platform (Outlet Pickup): Orders can be placed via our designated Online Ordering Platform, often accessible by scanning a QR code at the respective outlet. The process typically involves:

1. Selecting your desired menu items and adding them to your cart.

2. Validating the contents of your cart.

3. Providing necessary information, including your mobile phone number, for order communication and updates (as detailed in our Privacy Policy). It is your responsibility to ensure all selected items and quantities in your order are correct before completing payment. Once payment is made, the order is final as per Section 1.c.

4. Confirming your order and completing payment.

ii. In-Outlet Kiosks: Orders can be placed by selecting items and completing payment at our Kiosks located at our outlets.

iii. Cashier: Orders can be placed directly with our staff at the outlet Cashier.

b. No Pre-Orders: Regardless of the ordering channel, WOK HEY does not accept pre-orders for a future date or a significantly later time on the same day. Orders are intended for prompt preparation.

c. Order Finality: Payment for the Products makes the order final. Once payment is completed and the order is confirmed, no amendments, cancellations, or refunds will be entertained by or taken into consideration by WOK HEY, except as expressly stated in these Terms.

d. Order Confirmation (Online Orders): For orders placed via the Online Ordering Platform, WOK HEY will confirm the order. You will typically receive order status updates via WhatsApp or SMS to the mobile number you provide. It is your responsibility to provide an accurate and active mobile number.

e. Right to Refuse or Cancel Orders: WOK HEY reserves the right to cancel or refuse to accept any order from a customer at our sole discretion for any reason whatsoever. This may include, but is not limited to, orders from a customer with whom there is an ongoing dispute concerning payment of a previous order, orders that, in WOK HEY’s opinion, present any form of risk or appear fraudulent, or orders that cannot be fulfilled due to unavailability of Products (see Section 4).

f. Customer Responsibility for Information: You are responsible for ensuring that all information provided by you (including but not limited to mobile number, outlet selection, and order details) is accurate and complete. Any anomalies, errors, or inaccuracies in the information provided by you may result in the inability to process, fulfill, or communicate about your order correctly. WOK HEY shall not be liable for any loss, damage, or inconvenience occasioned thereby.

2. Payment

a. Online Ordering Platform:

i. Payment for online orders is made exclusively through our designated payment gateway (e.g., Adyen or Qlub).

ii. Accepted payment methods typically include Visa, MasterCard and American Express, as well as digital wallets such as Google Pay, Apple Pay and Samsung Pay. Accepted methods will be indicated on the payment page.

b. Outlet Kiosk Orders:

i. Payment methods accepted at our Kiosks will be displayed on the Kiosk interface and typically include card payments as well as digital wallets such as Google Pay, Apple Pay and Samsung Pay.

c. In-Outlet Cashier Orders:

i. Payment methods accepted at the Cashier include:

1. Cash

2. NETS

3. Credit/Debit Cards (including Paywave functionality and digital wallets)

4. NETS FlashPay

d. By providing your payment information, you confirm that you are authorized to use the chosen payment method and authorize us (or our third-party payment processor) to debit your account for the total amount due at the time of the order.

e. For your security, all digital and electronic payments are processed via a recognized secure payment system. While we take measures to ensure secure transactions, WOK HEY shall not be held liable for any instances of fraudulent payment card use.

f. If payment is declined or not authorized by the relevant banking institution or payment provider, the order shall be automatically cancelled, and you will be informed.

g. Ownership of Products: The title to the Products shall remain with WOK HEY until full payment of the price for the Products is received by WOK HEY. Risk of loss in respect of the Products passes to you upon successful collection from the designated outlet.

3. Prices, Order Collection, Cancellations, Refunds, and Amendments

a. Prices: All prices for Products are displayed on the Online Ordering Platform, Kiosks, or at the Cashier and are in Singapore Dollars (SGD), inclusive of any applicable Goods and Services Tax (GST). WOK HEY reserves the right to adjust prices at any time and this right remains exclusively with us. Any price changes will not affect orders already confirmed and paid for, except in cases of manifest error.

b. Outlet-Specific Ordering (Online): Our Online Ordering Platform links are specific to each WOK HEY outlet. It is your sole responsibility to ensure you are using the correct link and have selected the correct outlet for your intended pickup.

c. No Cancellations or Refunds After Preparation: Once an order is being prepared or has been prepared, it cannot be cancelled, and no refunds will be provided.

d. Incorrect Outlet Selection for Online and Third-Party Platform Orders: When placing an order for pickup via WOK HEY’s Online Ordering Platform or through on-demand food delivery applications including but not limited to GrabFood, Foodpanda, and Deliveroo, it is the customer’s responsibility to select the correct WOK HEY outlet. In the event an incorrect outlet is selected, you agree that such orders are non-cancellable, and no refunds will be issued by us. You further agree that WOK HEY is not required to transfer the order to an alternative outlet, even if order preparation has not yet commenced; instead, a new order must be placed and paid for at the correct location.

e. When ordering through on-demand food delivery applications including but not limited to GrabFood, Foodpanda, Deliveroo, you understand and acknowledge that you are bound by the terms and conditions of those respective platforms. WOK HEY’s only obligation is limited to the preparation and handling of the food order as transmitted to us via such platforms. WOK HEY does not coordinate with the on-demand food delivery service providers, and are not responsible for the delivery timing, handling, storage, transport or actions take by such service providers once the order has been collected and leaves our outlet.

f. No Amendments After Payment: Once payment for an order is processed and completed (whether online, at a Kiosk, or via the Cashier), you acknowledge and agree that such order is final, and no amendments, substitutions or modifications to the items, quantities or any other aspects of the order shall be accepted or permitted by WOK HEY.

g. Collection of Orders:

i. You will be notified (for online orders, typically via WhatsApp/SMS) when your order is ready for collection.

ii. Orders must be collected from the specified WOK HEY outlet during its operating hours.

iii. Food Safety and Quality: To ensure food quality and compliance with applicable food safety and hygiene standards, WOK HEY prepares all food items freshly at the point of order.

iv. Disposal of Uncollected Food: If an order is not collected within three (3) hours from the time it is notified as ready for collection (or by outlet closing time, whichever is earlier), WOK HEY reserves the right to dispose of the uncollected order. In such event, you agree that you shall not be entitled to and WOK HEY shall not be liable to you for any refunds, exchanges, or compensation in respect of such order.

4. Product Offers

a. Product Range and Availability: WOK HEY reserves the right, at its sole discretion, to add, replace, modify or discontinue any of its Product range and offerings at any time without prior notice. All Products are subject to availability. From time to time, certain promotions, offers or Products may be available only for a limited period of time. Any such limitations will be indicated as applicable.

b. Order Fulfillment: All orders are accepted subject to available stocks. WOK HEY undertakes to fulfill orders only to the extent that relevant Products are available at the time of order confirmation.

c. Post-Order Unavailability: In the rare event any Product included in your order becomes unavailable after your order has been confirmed and paid for, WOK HEY will endeavor to inform you as quickly as possible (e.g., by phone call or message to the mobile number provided for online orders, or in person for Kiosk/Cashier orders).

i. Any item that is unavailable will be automatically cancelled. You will be entitled to a full refund for the value of the unavailable item(s).

ii. Refunds for online and Kiosk orders will typically be processed within 30 days of payment, or as otherwise in accordance with the payment gateway’s processing timelines.

iii. Alternatively, where feasible and with your express agreement, WOK HEY may offer you a substitute Product of comparable value or a digital voucher of equal value of the original item.

iv. You agree and acknowledge that receipt of a refund or acceptance of a substitute Product or digital voucher shall constitute full satisfaction of WOK HEY’s liabilities in respect of unavailable Product(s), and no additional damages or compensation may be claimed.

d. By placing an order, customers acknowledge that all Products are prepared by WOK HEY in shared culinary environments where, despite having reasonable hygiene controls and precautions in place, unintended cross-contamination with allergens (including soy, gluten, sesame, dairy, egg, and nuts) may occur. If you have food allergies, it is your responsibility to enquire about allergen safety at the outlet or via customer service before placing your order. Customers with food allergies are strongly urged not to consume WOK HEY Products. To the fullest extent permitted by applicable laws, WOK HEY hereby disclaims all liability for any allergic reactions or health issues arising from cross-contamination with allergens, except where such allergic reactions or health issues resulted from WOK HEY’s negligence.

5. Promotions, Discounts, and Vouchers

a. From time to time, WOK HEY may offer promotions, discounts, or vouchers (the “Promotions”) to customers, through our Online Ordering Platform, outlets, or third-party partners. Such Promotions are subject to the following conditions unless otherwise specified:

i. Promotions are only valid for the period stated and may be limited to specific outlets, ordering times, Products, or ordering channels.

ii. Promotions are non-transferable, non-exchangeable, and cannot be resold or redeemed for cash.

iii. Only one promotion may be used per transaction unless explicitly stated otherwise.

iv. WOK HEY reserves the right to modify, suspend, or cancel any Promotions without prior notice.

v. WOK HEY reserves the right to verify the validty of any Promotions. Any suspected misuse of Promotional codes (including but not limited to duplication, resale, or fraudulent redemption) may result in cancellation of the order and/or refusal of future service.

vi. In the event of a conflict between the specific promotional terms and these Terms, the specific promotional terms shall prevail.

6. Intellectual Property

“Intellectual Property” means copyright, trade marks, service marks, design rights, patents, proprietary information rights, and all other similar proprietary rights, know-how, information, drawings, systems, products, processes, operational or instructional manuals, whether registered or unregistered or whether capable of registration, as may exist anywhere in the world, and shall include applications for any of the foregoing rights, all renewals and extensions of such rights or applications, all other proprietary rights whatsoever owned by WOK HEY and adopted or designated now or at any time thereafter by WOK HEY, and any work or creation prepared or created with any part of existing Intellectual Property.

All Intellectual Property pertaining to the content, materials, texts, remarks, illustrations, images and layout of the WOK HEY website, Online Ordering Platform, Kiosks, and all related marketing materials are owned by or licensed to WOK HEY. You agree not to reproduce, distribute, license, sell, modify, create derivative works of, republish or transmit, whether in whole or in part, WOK HEY’s Intellectual Property without prior written agreement from WOK HEY.

7. Prohibition of Sales Outside WOK HEY Network

WOK HEY Products are intended to be sold exclusively through our authorized WOK HEY outlets and official Online Ordering Platform. It is strictly prohibited to purchase WOK HEY Products for resale purposes outside of our authorized network, including through unauthorized websites or platforms. You shall not purchase WOK HEY Products for the purpose of resale, export or distribution unless you have obtained WOK HEY’s prior written consent. Unauthorised resale, export or distribution of WOK HEY Products may infringe our Intellectual Property, undermine product integrity, and may result in civil or criminal liability. WOK HEY reserves the right to take legal action against any individual or entity in breach of this clause.

8. Data Protection and Privacy

Our Privacy Policy (as annexed hereto and available at https://www.wokhey.sg/privacy-policy/) applies to your interactions with WOK HEY (including through our website, Online Ordering Platform, Kiosks, Cashiers, and related services). By placing an order and/or making a purchase, you acknowledge that you have read, understood and agree to the terms of our Privacy Policy, including our collection, use, and disclosure of your Personal Data as described therein.

9. Liability and Limitation of Liability

a. WOK HEY takes reasonable care in preparing and providing its Products. However, WOK HEY shall not be liable for any losses or damages, directly or indirectly caused by:

i. any inaccurate or incomplete information provided by you (e.g., wrong mobile number, selection of wrong outlet, inaccurate order details);

ii. your failure to collect your order within the timeframe stipulated in Section 3.g.

b. Under no circumstances shall WOK HEY be liable for any consequential, indirect or incidental damages, regardless of whether such damages were foresseable or whether you have been advised of the possibility of such damages, based on claims in contract, tort or otherwise howsoever, or arising out of or in connection with these Terms, or the promotion and sale of its Products..

c. To the fullest extent permitted by applicable laws, WOK HEY’s total liability arising from or in connection with any Product(s) you purchased is limited to the purchase price of such Product(s).

d. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by Singapore law.

e. Except as expressly stated in these Terms, WOK HEY makes no representations or warranties of any kind, express or implied, with respect to the Products offered, including but not limited to warranties of merchantability or fitness for a particular purpose. Products are sold on an ‘as is’ and ‘as available’ basis.

10. Governing Applicable Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore. You agree to submit to the exclusive jurisdiction of the courts of Singapore regarding any such dispute. In the event of any dispute arising from or relating to these Terms (including any question regarding its existence or validity) (the “Dispute”), the parties hereto shall first use their best resolve the matter amicably. To this effect, each party shall negotiate and attempt in good faith to resolve the Dispute within sixty (60) days from the date either party notifies the other of the Dispute. If the Dispute is not resolved by such manner the Dispute shall be referred to and finally settled by arbitration administered by the Singapore International Arbitration Centre in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be English.

11. Rights of Third Parties

A person who is not a party to these Terms shall have no right under the Contract (Rights of Third Parties) Act 2001 to enforce any part of these Terms.

12. Amendments to Terms and Notices

WOK HEY reserves the right to review, modify, update, or amend these Terms in our sole discretion and at any time by posting the amended terms on our website (www.wokhey.sg/terms-of-sale) or the Online Ordering Platform. It is the customer’s responsibility to check in from time to time to see if there are any changes. The terms applicable to your order will be those in effect at the time you place your order. We encourage you to review these Terms periodically.

13. Force Majeure

WOK HEY shall not be liable for any failure or delay in performance of its obligations under these Terms (including any failure or delay in fulfilling any orders), arising out of or caused, directly or indirectly, by Force Majeure. WOK HEY shall be excused from the performance of its obligations under these Terms for the duration of the Force Majeure. “Force Majeure” means circumstances beyond its reasonable control, including without limitation, acts of God; earthquakes; fires; floods; wars; civil or military disturbances; acts of terrorism; sabotage; strikes; epidemics; pandemics; riots; power failures; computer failure and any such circumstances beyond its reasonable control as may cause interruption, loss or malfunction of utility, transportation, computer (hardware or software) or telephone communication service; accidents; labor disputes; acts of civil or military authority; governmental actions; or inability to obtain labor, material, equipment or transportation.

14. Severability

If any provision of these Terms is found by any court or tribunal of competent jurisdiction to be invalid, unenforceable, or illegal, in whole or in part, the provision shall apply with whatever deletion or modification is necessary so that the provision is valid, enforceable and legal and gives effect to the commercial intention of the parties. To the extent it is not possible to delete or modify the provision, in whole or in part, such provision or part of it shall, to the extent that it is invalid, unenforceable or illegal, be deemed not to form part of these Terms and the validity, enforceability and legality of the remainder of these Terms shall, subject to any deletion or modification made hereunder, not be affected.

15. No Waiver

No failure or delay by WOK HEY in exercising or enforcing any right or remedy provided under these Terms or at law or in equity, shall constitute a waiver of such right or remedy. No single or partial exercise by WOK HEY of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy. A waiver of any breach or default shall apply only to such breach or default, and shall not constitute a waiver of any other breach or default occurring before or after such waiver.

16. Customer Conduct and Use of Services

You agree to use WOK HEY’s Online Ordering Platform, self-service kiosks, and interact with our personnel in a lawful, respectful, and appropriate manner. Failure to comply with the foregoing, including but not limited to, introducing any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful; attempting to gain unauthorized access to, interfering with, damaging or disrupting any part of our systems or data; engaging in any behaviour that is or is deemed by WOK HEY to be abusive, offensive, threatening, fraudulent, harassing, disruptive, inappropriate or otherwise objectionable, may result in immediate refusal of service, cancellation of your order, and/or restriction from accessing our services or purchasing our Products in the future.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WOK HEY concerning your purchase, and supersede any prior agreements, communications, or understandings, whether written or oral, regarding your purchase.

This Privacy Policy serves to inform you of our policies and procedures regarding the collection, use and disclosure of the Personal Data we receive when you access and use our websites/subdomains (including https://www.wokhey.sg) and mobile applications (collectively, the “Sites”) and all other products and services (all of the foregoing collectively and any of them, the “Services”) provided by WOK HEY Pte Ltd (“WOK HEY”, “our”, “us” and “we”). In this Privacy Policy, “you” and “your” mean you, the person accessing or using our Services.

This Privacy Policy is based on the Singapore Personal Data Protection Act 2012 (“PDPA”) and applies to Personal Data in our possession or under our control. This Privacy Policy is incorporated by reference into our Terms of Sales, currently available at https://www.wokhey.sg/terms-conditions/ (the “Terms of Sales”). By using our Services (including accessing our Sites), you consent to the practices and procedures described in this Privacy Policy.

How We Collect Your Personal Data

“Personal Data” refers to data, whether true or not, about an individual who can be identified (a) from that data, or (b) from that data and other information to which we have or are likely to have access. Examples of the types of Personal Data you may provide to us include, but are not limited to, your name, contact number (telephone/mobile), mailing address (residential and/or billing), network data (such as IP address or device identifiers), and any other information about you that is associated with or linked to any of the foregoing information.

We may collect Personal Data from you in various ways, including but not limited to, when you:

  • use our Services;
  • access or browse our Sites;
  • make purchases through our Sites or self-ordering kiosks;
  • participate in promotions;
  • offer feedback or reviews about our Services;
  • contact customer service;
  • subscribe to marketing communications; or
  • visit our physical premises.

Providing your Personal Data is voluntary. However, certain Personal Data may be necessary for us to provide you with access to or functionality within our Services. if you choose not to provide such Personal Data when requested, we may not be able to provide you certain features or functionalities, or the availability and quality of the Services may be affected.

Where you provide us with any Personal Data of third parties, you confirm that you have obtained all necessary concents to do so, and that we may collect, use and disclose such Personal Data for the purposes set out in this Privacy Policy, in accordance with the PDPA (and all amendments and regulations to the same).

We may engage third parties to operate the Sites on our behalf, and these third parties may collect Personal Data directly from you about your visits to the Sites on our behalf. We may also receive Personal Data about you from third parties where you have consented to such third parties sharing your Personal Data with us for specific purposes.

How We Use Your Personal Data

You agree that we may use your Personal Data for the following purposes set out in the list below (“Purposes”):

  • to provide you access to our Services, including our Sites;
  • to provide you with information about our Services;
  • to send you updates and information about your orders;
  • to fulfill your orders and process payments and refunds;
  • to gather customer feedback or reviews;
  • to provide customer service and support, and to respond and deal to your inquiries;
  • to communicate with you in respect of any correspondence or request that you have sent us;
  • to plan and run marketing campaigns;
  • to send you alerts, promotions, offers, and news about our products via email, SMS, social media, and other messaging applications (e.g. WhatsApp, Telegram, LINE, Viber, and WeChat);
  • to manage your participation in contests, promotions, and special events;
  • to conduct data analytics, including consumer research, trend analysis, and financial analysis, to understand and improve our Services, including our Sites;
  • to analyze, operate, evaluate, and improve our business, products, services, marketing, and online platforms (including our Services and our Sites);
  • to investigate accidents, incidents, or claims that may occur on our premises;
  • to protect against fraud and other illegal activities;
  • to enable us to enforce our legal rights and interests, including defending any claim, or to protect the rights, property or safety of our employees;
  • to comply with all applicable court orders, laws and regulations;
  • any other incidental business purposes related to or in connection with the above.

We will seek your consent before collecting any additional Personal Data and before using your Personal Data for a purpose which has not been notified to you (except where permitted or authorised by applicable laws).

How We Use Cookies

When you access and use our Sites, we use tools like cookies, pixels, and similar technologies (collectively called “Cookies”). These Cookies automatically gather anonymous information about the device you are using and how you browse our Sites. Cookies might be stored on your device, in emails we send, or on our Sites. The data collected includes information such as your browser type, IP address, time zone, which pages you visit, how you found our Sites (e.g., search terms or other websites), and how you interact with our pages.

Managing Your Preferences

You have the option to disable, block, or turn off cookies. However, please know that doing so might affect your experience, as some features of our Sites or Services may not work correctly or be available (e.g. you may not be able to access all or parts of our Sites).

Links To Other Websites and Social Medias

Our Sites may feature content and links to external websites or social media platforms operated by third parties that may also use Cookies. You may wish to review the privacy policies, terms, and other rules applicable to those third-party sites to find out how those sites collect and use your Personal Data and to establish whether and for what purpose they use Cookies. These third parties do not have access to our Cookies. WOK HEY does not control and is not responsible for the policies or practices of any third-party websites or services. The handling of any information you submit to them is subject to their own policies, and this Privacy Policy does not apply to them.

Personal Data of Minors

Our Sites are not intended for individuals under the age of 13. If you are under 13 years of age, please do not use our Sites or provide any Personal Data to us without the involvement or consent of your parent or guardian. We urge parents and guardians to monitor the use of all digital media by the minors under your care. If we become aware that we have collected Personal Data from an individual under the age of 13 without the involvement or consent of such individual’s parents or guardians, we will take steps to delete such Personal Data. Parents or guardians who believe their minors have provided us with Personal Data without their consent may contact us to request deletion. Please keep in mind that the deletion of such Personal Data may limit your or your minor’s access to all or a portion of the Services.

Disclosure of Personal Data

You agree that we may disclose or share your Personal Data with the following categories of recipients, for purposes consistent with those notified to you (including the Purposes) and where permitted or required by applicable laws:

  • any other entity within our group of companies, including our “related corporations” as defined in the Singapore Companies Act 1967;
  • service providers and business partners who perform services on our behalf or with whom we collaborate to provide our Services, including those who assist with:
    • processing payments;
    • storing data in the cloud;
    • managing documents and records;
    • advertising, marketing, and related platforms;
    • analyzing data;
    • conducting research;
    • educational or training initiatives;
    • providing and supporting our core technology, including computer systems, networks, and potentially internet-connected device (IoT) systems.
  • in the event of a proposed or actual merger, acquisition, financing, sale of assets, or any other situation where some or all of WOK HEY’s business assets might be transferred or otherwise disposed of; and
  • essential operations, such as those offering software platforms (SaaS) or managing promotions, contests, and prize draws. This sharing only occurs when necessary for them to perform these functions.

These service providers and business partners are only authorized to process, use or disclose your Personal Data in accordance with our instructions, including for the purpose of carrying out the Services on our behalf, and not for any independent use.

You agree that we may disclose your Personal Data without your consent where such disclosure is permitted or required under the PDPA, including but not limited to the following circumstances:

Use of CCTVS

We use closed-circuit television cameras (CCTVs) at our physical restaurant locations for the safety and security of our customers, staff, and property. These CCTVs may record images and video footage of individuals within their field of view.

This includes deterring and detecting criminal activity such as theft, vandalism, or assault, ensuring the safety and well-being of both the public and our staff, and investigating any accidents, incidents, or claims that may occur. In limited circumstances, we may also use anonymized or aggregated CCTV data, with safeguards to ensure no individuals are identified, to analyze customer traffic flow and improve operational efficiency. Finally, we use CCTV footage as necessary to comply with applicable laws, regulations, or legal requests from authorities.

Types of Data Collected Via CCTV

The CCTVs may capture the following types of data:

  • Images and Video Footage: Recordings of individuals, their actions, and their surroundings.
  • Date and Time Stamps: Information about when the recordings were made.
  • Camera Location: Information about the specific camera that captured the footage.

Disclosure of CCTV Footage

We disclose CCTV footage only under limited and necessary circumstances. Primarily, this may involve sharing footage with law enforcement or government authorities when required by law or legal process, or if we have a good faith belief that disclosure is necessary to prevent harm or investigate potential criminal acts. We may also provide footage to our legal advisors for handling legal proceedings or claims, and to our insurance providers in connection with relevant incidents or claims. Separately, third-party service providers who help install, maintain, or operate our CCTV systems might need access to footage to perform their duties. When this occurs, these providers are required by contract to uphold the confidentiality and security of the footage they access on our behalf.

Retention of Personal Data

We may retain your Personal Data for as long as it is necessary to fulfill the purposes for which it was collected, or as required or permitted by applicable laws. We will cease to retain your Personal Data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose(s) for which the Personal Data was collected and is no longer necessary for legal or business purposes.
